Ministerial Decision on the mandatory application of the digital card in tourism and food and beverage services as of 11-9-2024.

Decision No. 44485/2024 of the Minister of Labour and Social Security [MD], which was published in the Government Gazette (B/5151/11-9-2024), specifies the sectors and Business Activity Codes [KAD] of the companies that are obliged to implement the digital work card system as of 11-9-2024.

Specifically:

In accordance with the above mentioned Ministerial Decision, the following are provided:

-As of September 11, 2024, the following enterprises are included mandatorily in the digital work card system:

A) the enterprises belonging by main activity (based on Business Activity Code [KAD]) to accommodation services of the tourism sector, and

B) the enterprises belonging by main activity (based on Business Activity Code [KAD]) to the food and beverage services sector

Furthermore, regarding the administrative sanctions concerning the implementation of the Digital Work Card System, it is provided that the administrative sanctions are being imposed, for both of the above sectors (i.e. for enterprises) as of Match 1, 2025.

– The companies with the above Business Activity Codes [KAD] are obliged, as of the date of their inclusion, to have and activate, respectively, a digital work card system for all their employees with a contract or dependent employment relationship, who provide work with physical presence at the place of employment of the enterprises-employers, regardless of whether their branches are in incorporated KAD, including the employees who are employed in the above enterprises through lending arrangements.

For these companies, since the main company-employer KAD in TAXIS is included in the digital work card and multiple activities are performed in the same place, some of which have not yet been included in the digital card, there is now an obligation to apply the mechanism for all of the their employees.

Finally, according to the above mentioned Ministerial Decision, certain exceptions to the implementation of the digital work card system are also being provided.
