Law 5157/2024: Employees entitled to a disability pension will no longer need to terminate their employment
Law 5157/2024 was published with the title: “Reform of the institution of the Personal Physician – Establishment of University Health Centers – Disability pension due to common disease and other provisions”.
As per article 43 of Law 5157/2024 the insured individuals of e-EFKA, who are entitled to a main pension due to disability caused by a common disease, will no longer need to interrupt their work in order to receive it.
Specifically, article 43 of Law 5157/2024 amended the previously applicable legal framework under article 11A of Law 4387/2016, effective as of January 1st , 2024.
According to the new legislation, e-EFKA insured individuals are entitled to a main pension due to disability from a common disease for as long as they are certified as disabled (at a percentage of at least 50%), provided that they have completed in a main insurance sector:
1) at least 15 years or 4,500 days of insurance, or
2) at least 5 years or 1,500. At least 2 years or 600 days of insurance must be within the last 5 years prior to the date or year of commencement of disability, or
3) at least 1 year or 300 days of insurance and the insured person has not reached the age of 21. The 300 days of insurance are progressively increased to 1,500 with the addition of 120 for each year of age beyond 21 up to and including 31.
Finally, it is noted that applications submitted from January 1st , 2024 and rejected due to no prior termination of the insured employment may be resubmitted within six months from the publication of Law 5157/2024, with retrospective effect.
