Circular of the Ministry of Labour and Social Security: Instructions for the implementation of the Digital Work Card
On June 21, 2024, the interpretative circular No. 37271/21-6-2024 was issued by the Ministry of Labour and Social Security under the subject: Instructions for the implementation of the Digital Work Card.
By the aforementioned circular, clarifications are provided regarding the following topics:
A. General assumptions regarding the use of the digital work card at the present stage (First Implementation Phase)
B. Main employer/undertaking activity code numbers (KADs) in TAXIS and inclusion in the Digital Work Card
C. Exemptions from the Digital Organisation of Working Time and the Digital Work Card Mechanism
D. Punching of the Digital Work Card – Discrepancies between the working time declared in the Digital Organisation of Working Time and entries (“punches”) marked on the Digital Work Card, and namely clarifications are provided as of the following specific cases:
- “Flexible Arrival Time” and digital card punches
- Option to choose an ex-post reporting system for registering changes in working hours, the organization of working time and overtime
- Missing digital work card data or failure by the undertaking to submit in time the digital card data to the ERGANI II Information System
- Cases of justified non-punching of the digital work card (teleworkers, special categories of employees with a non-fixed place of work, managerial employees)
- Punching of the Digital Work Card for employees working a) in security enterprices, b) in industrial undertakings, c) under loan, and d) in contract projects
