Ministerial Decision on the mandatory application of the Digital Card in industry and retail trade as of 1-1-2024.
Decision No. 113169/2023 of the Minister of Labour and Social Security, which was published in the Government Gazette (A/7421/28-12-2023), specifies the sectors and Business Activity Codes [KAD] of the companies that are obliged to implement the digital work card system as of 1 -1-2024.
Specifically:
In accordance with Part A of the above mentioned Ministerial Decision, the following are provided:
-As of January 1, 2024, the following enterprises are included mandatorily in the digital work card system:
A) the enterprises belonging by main activity (based on Business Activity Code [KAD]) to the industry sector, except for the companies which are active in the energy, petroleum and mining sectors (i.e., all Business Activity Codes [KAD] with first two digits from 10 to 33, except 19), and
B) the enterprises belonging by main activity (based on Business Activity Code [KAD]) to the retail trade sector (i.e., all Business Activity Codes [KAD] with first two digits of 47), except for the companies which are active in the trade of motor vehicles and motorcycles.
Furthermore, regarding the administrative sanctions concerning the implementation of the Digital Work Card System, it is provided that the administrative sanctions are being imposed:
i) for enterprises belonging to the industry sector, as of April 1, 2024 and
ii) for enterprises belonging to the retail trade sector, as of May 2, 2024;
iii) for both of the above sectors (i.e. for enterprises) with a number of employees not exceeding 10 as of May 13, 2024.
– The companies with the above Business Activity Codes [KAD] are obliged, as of the above mentioned dates, to have and activate, respectively, a digital work card system for all their employees with a contract or dependent employment relationship, who provide work with physical presence at the place of employment of the enterprise, including the employees who are employed in the above enterprises through lending arrangements.
